These Terms of Sale (“Terms”) govern all purchases made from Twinkle n Grace, a trading name of Fortanex Holdings Pty Ltd (ABN 86686761179), referred to in these Terms as “Twinkle n Grace”, “we”, “us”, or “our”.
By placing an order through our website (the “Site”), you agree to be bound by these Terms, as well as our Terms of Service, Privacy Policy, Shipping Policy, Return and Refund Policy, and Warranty Policy all of which are incorporated by reference.
1.1 We have made every effort to provide an accurate representation of our products and services in our online stores. However, please note that colors or product appearance may differ from how they may appear on your screen due to the type of device you use to access the store and your device settings and configuration.
1.2 We do not warrant that the appearance or quality of any products or services purchased by you will meet your expectations or be the same as depicted or rendered in our online stores.
1.3 All descriptions of products are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of any products that we offer to any person, geographic region or jurisdiction, on a case-by-case basis.
1.4 All products are subject to availability. If an item is out of stock, we may notify you and offer a substitute, a backorder, or a refund.
2.1 All orders placed through our Site are offers to purchase products in accordance with these Terms.
2.2 We reserve the right to accept or decline any order, in whole or in part, for any reason.
2.3 Once your order is placed, you will receive an email confirming that we have received it. This confirmation does not signify acceptance. Your order is accepted when we send a confirmation of shipment or delivery. We must receive and process your payment before your order is accepted.
2.4 Please review your order carefully before submitting, as Twinkle n Grace may be unable to accommodate cancellation requests after an order is accepted. In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the e‑mail, billing address, and/or phone number provided at the time the order was made.
2.5 In the unlikely event that a product becomes unavailable after you place your order, we will contact you to offer an alternative or a full refund.
2.6 Your purchases are subject to return or exchange solely in accordance with our Return and Refund Policy.
2.7 You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.
3.1 All prices are listed in Australian Dollars (AUD) and include Goods and Services Tax (GST) unless otherwise stated.
3.2 We reserve the right to change prices at any time without notice, but such changes will not affect confirmed orders.
3.3 The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email.
3.4 Payments must be made at the time of ordering using one of the available payment methods displayed at checkout.
3.5 You agree to provide current, complete and accurate purchase, payment and account information for all purchases made at our stores. You agree to promptly update your account and other information, including your email address, credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
3.6 By providing your payment details, you represent that you are authorised to use the selected payment method.
3.7 You represent and warrant that (i) the credit card information you provide is true, correct, and complete, (ii) you are duly authorized to use such credit card for the purchase, (iii) charges incurred by you will be honored by your credit card company, and (iv) you will pay charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes, if any.
3.8 If there is an error in pricing, we reserve the right to cancel or revise the order before shipping. If this occurs, you will be contacted and offered the option to proceed or cancel for a full refund.
4.1 We may offer, from time to time, promotions on the Services that may affect pricing and that are governed by terms and conditions separate from the above Pricing and Payment Terms. If there is a conflict between the terms for a promotion and these Terms, the promotion terms will govern.
4.2 Promotional offers, discount codes, or vouchers are valid only for the time specified and may have additional conditions.
4.3 Only one discount code can be applied per order unless explicitly stated otherwise.
4.4 We reserve the right to withdraw or amend any promotional offer without prior notice.
5.1 We ship across Australia using trusted delivery partners. Estimated delivery times and costs are displayed at checkout and detailed in our Shipping Policy.
5.2 We aim to dispatch orders promptly, but delivery times may vary due to carrier delays or external factors beyond our control.
5.3 Risk of loss or damage to goods passes to you upon delivery to your nominated address.
5.4 Please ensure all shipping details are accurate. We are not responsible for parcels lost or delayed due to incorrect addresses.
6.1 We want you to love your purchase. Please refer to our Return and Refund Policy for detailed information on returns, refunds, and exchanges.
6.2 Our goods come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
7.1 Store credits may be issued by Twinkle n Grace as part of a return, exchange, or promotional offer. Store credits are applied to your customer account and may only be used to purchase eligible products on our website.
7.2 Unless otherwise stated, store credits are valid for 3 years from the date of issue. Expired credits cannot be reissued or redeemed.
7.3 Store credits are non-transferable, cannot be redeemed for cash, and may not be used to purchase gift cards.
7.4 If you return an item purchased using a store credit, the refunded amount will be reissued as store credit.
7.5 Promotional Credits
Promotional or goodwill credits may have additional conditions, such as shorter validity or limited applicability. Any such conditions will be communicated at the time of issue.
8.1 Gift cards issued or sold by Twinkle n Grace (Fortanex Holdings Pty Ltd) can be used to purchase eligible products on our website at www.twinklengrace.com.au
8.2 Gift cards may be purchased by customers or issued by Twinkle n Grace as part of a promotion, refund, or goodwill arrangement.
8.3 Gift cards are not redeemable for cash, cannot be transferred, and may not be used to purchase other gift cards.
8.4 Gift cards are valid for three (3) years from the date of issue, in accordance with Australian Consumer Law, unless otherwise stated on the card.
8.5 Please treat your gift card like cash. Twinkle n Grace is not responsible for lost, stolen, or unauthorised use of gift cards.
8.6 You can check your gift card balance at any time by opening the gift card page link included in your original gift card email. If you experience any issues accessing your balance or have questions about your gift card, please contact our customer care team at twinklecare@twinklengrace.com.au.
8.7 Twinkle n Grace reserves the right to cancel a gift card or suspend its use if we suspect fraudulent activity, misuse, or breach of these Terms.
9.1 Twinkle n Grace provides a limited warranty on its artificial Christmas trees:
- 5-year limited warranty on the tree structure.
- 3-year limited warranty on factory-fitted lights.
9.2 These warranties cover defects in materials or workmanship under normal, intended household use. They do not cover damage caused by improper use, modification, neglect, or accidents.
9.3 For full warranty terms, claim procedures, and exclusions, please see our Warranty Policy. This Policy forms part of these Terms by reference.
9.4 Your statutory rights under the Australian Consumer Law (ACL) are not affected. You are entitled to a replacement, repair, or refund if the product fails to meet the guarantees required by law.
10.1 To the fullest extent permitted by law, our total liability to you for any claim relating to a purchase shall not exceed the amount paid for the relevant product.
10.2 We are not liable for indirect, incidental, or consequential losses arising from your use of the products or the Site.
11.1 Ownership of products passes to you once full payment is received.
11.2 Risk in the products passes upon delivery to your nominated address.
12.1 While we strive for accuracy, typographical errors, inaccuracies, or omissions may occur in product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability.
12.2 We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order).
13.1 These Terms of Sale are governed by the laws of the State of Victoria, Australia, and any disputes shall be subject to the exclusive jurisdiction of the courts of Victoria.
